Third-party liability insurance related to the ownership and usage of aircrafts
Subject of the insurance:
Third-party liability insurance of the insured natural and legal persons for the pecuniary and non-pecuniary damage caused by them, as result of usage and/or ownership of aircrafts. Applied in two clauses:
Third-party liability insurance (other than passengers)
Third-party liability insurance to passengers
Covered risks
The Third-party liability insurance (other than passengers), in case of the occurrence of insured event, the insurer will cover all sums, that will be claimed through legal actions towards the insurer and the insurer must pay the sums as indemnity /including legal expenses/ as a result of bodily injury /fatal or not/ or damages to incidental damage to property, caused directly by the aircraft or by any person or object that has fallen from it.
The insurer is not liable to claims for bodily injury /fatal or not/ or damage to:
Director, employee or partner of the insurer in a moment of work and performance of duties, assigned by the insurer;
Member of the flight, crew member or other personnel on board, engaged in the control of the plane;
Passenger, during boarding or disembarkation or during the stay on board;
Insurances of losses or damage to any property type, belonging to the insured person or subjected to his/her care and control;
Pollution, noise and others.
For the clause Third-party liability to passengers, the insurer will indemnify the insured person for all sums, which the insurer is ordered by the court to pay and/or will pay, as a compensation for damage / legal expenses/ in relation to:
accidental bodily damage /fatal or not/ of passenger, during boarding or disembarkation or during the stay at the plane;
loss or damage of luggage and personal belongings of passengers, related to an incident at the plane.
The insurer is not liable to claims for bodily injury /fatal or not/ or damage to:
Director, employee or partner of the insurer in a moment of work and performance of duties, assigned by the insurer;
Member of the flight, crew member or other personnel on board, engaged in the control of the plane;
Aviation Hull Insurance
Subject of the insurance:
Subject of that insurance are airplanes, helicopters and other aircrafts, that are insured against total loss or partial damage.
Covered risks
All risks that can occur during taking off, flying, landing and taxiing are covered, as well as additional costs due to coercive measures for the provision of immediate security of the aircraft as a result of damaged suffered or forced landing. With some insurers, these expenses reach 10%.
Excluded risks:
The insurer is NOT paying indemnity for:
Usage of the aircraft for unlawful purposes or other special usages;
All cases in which the aircraft is used outside the geographic limits, specified in the insurance policy, except the cases of force majeure;
The cases, when the aircraft is piloted by individuals other than the authorized;
In cases of landing or taking off of the aircraft at a location, not in the conformity of the recommendations of the aircraft manufacturer;
Presence of more passengers on board than the declared number of seats in the plane.
Damages caused in an act of terrorism or war.
Any malicious actions and sabotage.
Insurance sum
– is the actual value of the aircraft as to the time of the conclusion of the insurance.
Insurance premium:
as per the actual and enforced tariff of the insurer. It usually consists of two components – “during a flight” and “at the ground”.
Insurance term
– 1 year.
